Legal regulation of trademarks in Ukraine

Rights and obligations of trademark owners

Rights of trademark owners
 

Theright to exclusive use of the trademark. Trademark owners have the exclusive right to use their trademark to identify the goods and services specified in the registration.

Obligation tomaintain the validity of registration. Trademark owners are obliged to pay the established fees to maintain the validity of their trademark registration throughout the entire period of its validity.
 

The obligation to comply with theterms of the license agreement. In case of transfer of rights to a trademark under a license agreement, the owners are obliged to comply with the terms of the agreement, including control over the quality of goods and services marked by the licensee.
 

Trademark registration procedure
 

The trademark registration procedure in Ukraine includes several main stages:
 

Preparation of the application. The applicant prepares an application for trademark registration, which must contain an image of the trademark, a list of goods and services for which the trademark is registered, and an application for registration.
 

Filing anapplication. The application is filed with Ukrpatent together with the relevant documents and payment of the established fees.
 

Examination of theapplication. Ukrpatent conducts an examination of the application, which includes formal examination (checking the correctness of the application) and qualification examination (checking the compliance of the mark with the requirements of the law, including novelty and absence of conflicts with other registered marks).

Protection of trademark rights

Administrative protection. It is carried out by applying to state authorities, in particular to Ukrpatent or the Antimonopoly Committee of Ukraine.

International trademark registration
 

Ukraine is a party to a number of international trademark agreements, which provides for international trademark registration for Ukrainian applicants. The main mechanisms for international trademark registration include:
 

Paris Convention for the Protection of Industrial Property. This convention provides for the possibility to file an application for trademark registration in any member state within 6 months from the date of filing the first application in one of the member states.
 

Madrid Agreement Concerning the International Registration of Marks and its Protocol. These international treaties allow you to file an international trademark application through WIPO (World Intellectual Property Organization), which is valid in all countries that are parties to the agreement and protocol.
