It should be noted that not only a person who physically commits murder can be punished for this crime. Article 115 of the Criminal Code of Ukraine (CPC) provides for responsibility for murder. Part 1 of this article (Article 115 part 1 of the Civil Code) establishes the following: "Murder, provided for in the first part of this article, i.e. intentionally causing death to another person, is punishable by imprisonment for a term of seven to fifteen years." Therefore, according to Article 115, Part 1 of the Criminal Code, the penalty for committing murder is imprisonment for a term of 7 to 15 years.
According to Part 2 of Article 115 of the Criminal Code (Article 115 h 2 of the Criminal Code): "The murder provided for in part one of this article, which is committed: with particular cruelty; a large number of people; for the purpose of concealing another crime or causing impunity for it; in case of previous or simultaneous commission of two or more murders; in case of murder of a child or a pregnant woman, if it is known that the woman is pregnant, or in case of murder in grave or particularly grave circumstances; for the purpose of kidnapping or in the case of murder in the context of kidnapping; in case of committing a crime on the territory of a foreign state under other exceptional circumstances; in the event of the murder of a citizen of Ukraine or a foreigner with the aim of influencing state authorities, local self-government bodies, as well as mass media, shall be punished by deprivation of liberty for a term of ten to twenty-five years or life imprisonment." Therefore, for the commission of murder in certain circumstances, which are listed in part 2 of Article 115 of the Criminal Code, a more severe punishment is provided - imprisonment for a term of 10 to 25 years or life imprisonment is deprivation of liberty.
