Kidnapping

Kidnapping is a serious crime that includes the illegal removal of a person against their will. This can be done for a variety of reasons, such as extortion, political purposes, sexual exploitation or criminal activity.

The legislation of various countries provides for serious punishments for illegal deprivation of liberty, as it violates basic human rights and freedoms. People who kidnap others may be subject to criminal prosecution and punishment under applicable law. The recovery of the injured person and his safety is a priority for law enforcement agencies in such situations. In Ukraine, illegal deprivation of liberty or kidnapping is a serious crime according to the Criminal Code. He is punished according to the law. Various punishments, including deprivation of liberty, may be prescribed for this.

Ukrainian legislation also defines procedures for investigating and prosecuting cases of kidnapping. Law enforcement agencies, in accordance with the law, conduct an investigation and try to find the victim, as well as bring the perpetrators of this crime to justice. In cases of kidnapping, extortion or other serious violations of human rights, law enforcement officers respond immediately and make efforts to resolve the situation and protect the victims.

Article 146 of the CCU contains the following: "Kidnapping a person Kidnapping a person, keeping him in captivity or keeping him in isolation without grounds provided for by law is punishable by imprisonment for a term of three to fifteen years with confiscation of property. The same actions committed by a group of persons under coercive circumstances or in relation to a minor or due to the use of an official position, - shall be punished by deprivation of liberty for a term of eighteen to twenty-five years with confiscation of property."

Therefore, in accordance with Article 146 2 of the Criminal Code, if a kidnapping is committed by a group of persons under coercive circumstances, in relation to a minor or as a result of the use of an official position, a more severe punishment is provided - imprisonment for a term of eighteen to twenty-five years with confiscation of property.

Article 146 of the Criminal Code also refers to illegal deprivation of liberty, which can be considered a form of kidnapping. It provides punishment for those who keep a person in captivity or keep him in isolation without the grounds provided by law.

According to this article, illegal deprivation of liberty can lead to imprisonment for a term of three to fifteen years with confiscation of property. If these actions are committed by a group of persons, under coercive circumstances, in relation to a minor or as a result of using an official position, then an even more severe punishment is provided - imprisonment for a term of eighteen to twenty-five years with confiscation of property.
