Article 356 of the Civil Code of Ukraine (CCU) regulates the issue of the violation of a debt obligation by a unit after the execution of a pledge or the transfer of property at the expense of the debt. The main content of the article is to establish the rights and obligations of the parties in case of breach of obligations related to pledge or transfer of property due to debt.
According to Article 356 of the Criminal Code, the following is provided for:
Breach of a debt obligation: In the event that a unit violates its debt obligations after making a pledge or transferring property at the expense of the debt, the pledgee (the person who provided the pledge) has the right to demand the return of the property or compensation for its loss in the amount of the debt.
Claim procedure: The pledgee has the right to claim the return of the property or compensation for its loss through court proceedings or through amicable settlement with the unit that violated the obligation.
Limitation of claims: The right of the mortgagee to demand the return of property or compensation may be limited by the time limits established by law for the fulfillment of such claims, as well as by other legal circumstances.
Liability for breach of obligation: A unit that has breached its debt obligations shall be liable to the pledgee in the form of restitution of property or compensation for its loss in accordance with the law.
Therefore, Article 356 of the Civil Code establishes the legal regime for breach of debt obligations after the pledge or transfer of property due to debt and determines the rights and obligations of the parties in such cases.
