The lawyer enters into an agreement with the client, conducts a legal analysis of the situation, analyzes documents, prepares an application for deferment from military service, and submits it to the Territorial Military Commission (TMC) and Military Registration and Enlistment Office (MREO).
The client provides the lawyer with all available documents. The lawyer conducts a detailed analysis and provides a legal conclusion regarding your specific situation, taking into account all nuances.
After analyzing the documents, the lawyer will clearly specify which documents are necessary to obtain a deferment. The client must gather all necessary documents to initiate the process. As part of the agreement with the client, the lawyer assists in collecting the necessary documents. The ultimate result of this stage is a file of collected documents and a drafted application.
After gathering all documents, the lawyer compiles the case and submits it to the relevant TMC and MREO. The lawyer sends a request to the TMC and MREO for deferment with a description of the enclosure and copies of all necessary documents. The ultimate result of this stage is proof of document submission to the TMC and MREO.
In case of violations of the conscript's rights, the lawyer obtains all evidence of the violations from the employees of the TMC and MREO and files a complaint with the regional TMC and MREO to resolve the issue and obtain deferment. In such a case, the decision regarding deferment for the conscript is made by the regional TMC and MREO, as the work of regional TMCs and MREOs is better regulated by the Ministry of Defense of Ukraine than district ones.
Once the case is with the TMC and MREO, the lawyer sends a legal inquiry to the TMC to request the head of the TMC (head of the Medical Board) to report on the conscript's status. This way, the lawyer ensures the legality of the actions of the TMC and MREO employees. Therefore, representatives of state bodies and institutions must respond to the legal inquiry within 5 business days.
The result of providing this service is a Legal Conclusion, prepared in writing on the company's letterhead, signed by the person who prepared it, and scanned in PDF format. This conclusion can be used directly by the individual for their own purposes and can also be provided to third parties.
