24.09.2022 11:25:17 Адвокатська таємниця передбачена статтею 22 Закону України "Про адвокатуру та адвокатську діяльність". Якщо просто, до адвокатської таємниці відноситься будь-яка інформація та документи, отримані адвокатом від клієнта. Адвокат та його помічники зобов'язані зберігати адвокатську таємницю. Зазвичай адвокат має бути нейтральним: він не займає нічію сторону, а лише захищає інтересі свого клієнта. Але адвокат теж людина зі своїми поглядами і життєвими переконаннями, тому він може відмовитись від роботи з клієнтом, який свідомо порушує закон (і адвокат має на це право). Зберігати адвокатську таємницю адвокат зобов'язаний і після припинення роботи з клієнтом. Порядний адвокат не стане розголошувати приватну інформацію про свого колишнього клієнта, навіть якщо той від чогось ухилився або щось порушив. За розголошення адвокатської таємниці для адвоката передбачена дисциплінарна відповідальність у вигляді позбавлення права на зайняття адвокатською діяльністю.
