10.06.2022 15:28:29 Законом не передбачено звільнення платника аліментів від з щомісячної сплати аліментів в разі втрати роботи чи перебуванні в статусі безробітного. Якщо аліменти не сплачуються, виконавець нараховує боржнику заборгованість зі сплати аліментів виходячи із середньої заробітної плати працівника для даної місцевості. Вам слід стати на обліку в центрі зайнятості як безробітний і з отриманої допомогу по безробіттю будуть стягуватися присуджені аліменти. А матір дитини поки нехай звернется за отриманням допомоги у звязку з відсутністю у боржника коштів. Для того, щоб призначили тимчасову допомогу від держави, їй треба зверунтися в орган соцзахисту за своїм місцем проживання.
12.06.2022 09:12:43 Держава на час воєнного стану дозволяє перераховувати аліменти, які стягуються з заробітної плати чи пенсії боржника, безпосередньо стягувачу аліментів на особисту банківську картку, минаючи виконавчу службу. Статтею 196 Сімейного кодексу України передбачена відповідальність за прострочення сплати аліментів, зокрема у вигляді стягнення за рішенням суду неустойки (пені) у розмірі 1% суми несплачених аліментів за кожен день прострочення від дня прострочення сплати аліментів до дня їх повного погашення або до дня ухвалення судом рішення про стягнення пені, але не більше 100% заборгованості. Розмір неустойки може бути зменшений судом з урахуванням матеріального та сімейного стану платника аліментів. Заборгованість за аліментами платника аліментів, який не працював на час виникнення заборгованості або є фізичною особою-підприємцем і перебуває на спрощеній системі оподаткування, або є громадянином України, який одержує заробіток (дохід) у державі, з якою Україна не має договору про пра
