11.02.2022 10:05:03 Відповідно до ст. 3 Сімейного Кодексу сім’ю складають особи, які спільно проживають, пов’язані спільним побутом, мають взаємні права та обов’язки. Сім’я створюється на підставі шлюбу, кровного споріднення, усиновлення, а також на інших підставах, не заборонених законом і таких, що не суперечать моральним засадам суспільства. Відповідно до ст. 21 СК шлюбом є сімейний союз жінки та чоловіка, зареєстрований у державному органі реєстрації актів цивільного стану. Проживання однією сім’єю жінки та чоловіка без шлюбу не є підставою для виникнення у них прав та обов’язків подружжя. Розподіляти можна тільки спільне майно, але для цього хтось повинен визнати факт спільної сумісної власності на нього. Статтею 74 Сімейного кодексу України встановлено, що якщо жінка і чоловік проживають однією родиною, але не перебувають між собою у шлюбі, майно, нажите ними за час спільного проживання, належить їм на правах спільної сумісної власності, якщо інше не встановлено письмовим договором між ними.

12.02.2022 11:55:51 Доброго Вечора претендувати на житло він не може так як прав власності на житло у нього немає спільне проживання і навіть реєстрація у житлі правами власності не наділяє. Єдине на що він може претендувати це повернення коштів які він вам позичав з відсотками при умові що ви їх йому не повернули. У відповідності до ст. 1049 Цивільного Кодексу України, позичальник зобов'язаний повернути позикодавцеві позику (грошові кошти у такій самій сумі або речі, визначені родовими ознаками, у такій самій кількості, такого самого роду та такої самої якості, що були передані йому позикодавцем) у строк та в порядку, що встановлені договором. Якщо договором не встановлений строк повернення позики або цей строк визначений моментом пред'явлення вимоги, позика має бути повернена позичальником протягом тридцяти днів від дня пред'явлення позикодавцем вимоги про це, якщо інше не встановлено договором.
