Recently, our team was asked a question: “Добрий день. Я вела відеозйомку в громадському місці, до мене підійшла дівчина та вимагала припинити знімати відео.На мою відповідь ні, вона почала погрожувати мені. Як мені діяти в даній ситуації?”

29.06.2021 18:26:07 За законом, знімати на відео чи фотографувати у громадських місцях можна. Заборонити зйомку не можуть службові, публічні особи або посадові, якщо ви не перешкоджаєте їхній роботі. А от випадкові перехожі, мають право сказати, що вони не хочуть, аби їх знімали, та вимагати видалити матеріали з їхнім зображенням. І саме так Ви повинні зробити. Ст. 307 Цивільного кодексу України передбачено, що людей не можна знімати на фото або відео без їхньої згоди.Ця норма закону розповсюджується лише на фізичних осіб та не може бути використана щодо службових, посадових або публічних осіб. Краще видаліть запис. Дякую.

Право вільно збирати та поширювати інформацію гарантовано ст. 134 Конституції України, а в публічних місцях презюмується згода на зйомку статтями 307, 308 Цивліьного кодексу України. Якщо особа підійшла і намагається закрити камеру (простягає руки до неї) повідомте, що ви викличете поліцію за намагання пограбувати Вас за ст. 186 Кримінального кодексу України і особі загрожує до 5-ти років позбавлення волі. Дякую!
29.06.2021 20:39:28 Право на фото- відеозйомку регламентовано ст. 37 Конституції України, однак, воно не є абсолютним і може бути обмежене. За загальними нормами цивільного законодавства фізичну особу треба знімати відрито, заручившись її письмовою або усною згодою. Існує і принцип мовчазної згоди, коли людина знає і бачить, що її знімають, але не повідомляє, що забороняє себе знімати, не використовує заборонні жести і не закриває обличчя від камери. На публічних заходах діє презумпція згоди на зйомку. Пам’ятайте, якщо людина проти того, щоб її знімали, вона не має права вилучати або псувати вашу техніку, але ви зобов’язані видалити кадри з її участю. Тому дотримуйтесь балансу між правом на фото- і відеозйомку і правами людей, яких ви знімаєте.
