Recently, our team was asked a question: “Добрий день. Моя квартира записана на 2-х власників, мене і мого брата. В квартирі він вже не мешкає більше 6 років, за комунальні послуги не платить. Чи можу я виписати його з квартири? За яких підстав, я можу виписати його з квартири?”

22.10.2021 12:03:38 Доброго дня. Оскільки Ваш брат є співвласником квартири, то примусово виписати Ви його не зможете, лише за його добровільною згодою. На жаль суд не дозволить виписати співласника. Домовляйтесь з братом. Дякую.

Попросити брата добровільно виписатися з квартири (через ЦНАП) і нарахування ком послуг буде на 1 особу. 2.Судовий відповідно до Сімейного та Цивільного кодексів України, у цьому випадку спір вирішується лише через суд. Власник повинен надати докази того, що згадана людина не живе у квартирі понад рік.Після шести місяців відсутності такої особи у помешканні, на неї можна подати у суд для виписки. Допоможе виграти справу відповідний акт із ЛКП або ОСББ та свідчення сусідів. До того, як виписати людину з квартири за допомогою суду, необхідно зібрати наступні документи: оригінал квитанції про оплату судового збору; копії вашого паспорта та коду; копії паспорта та коду відповідача (якщо є); документи, що підтверджують ваше право власності на квартиру; якщо раніше зверталися в ЦНАП - письмову відповідь з відмовою у виписці; документ, що підтверджує, що дана особа не проживає в квартирі протягом такого-то часу; довідка про склад вашої сім'ї.
22.10.2021 21:42:58 Особу, яка є співвласником будинку чи квартири неможливо визнати такою, що втратила право користування жилим приміщенням, та виписати. І факт проживання не має жодного значення. Це, зокрема, підтверджено позицією Верховного Суду(https://reyestr.court.gov.ua/Review/95907443?fbclid=IwAR23gYfY1EhIhEqgb0soVzBlCVTSbWMVFimQVt0onsi8lhYnWRmxDDDDjDQ).
