У нього загинув неповнорідний брат. Наразі він воює. Тепер знову поновили цей пунк закону, і повернули "Неповнорідний" В брата зявилось знову право. Але тепер він військовий. Які наші дії?”

23.09.2024 15:05:14 Спочатку потрібно звернутися до військової комісії або до відділу кадрів, щоб довести їм, що брат має право на відстрочку за цим пунктом закону. Це може забезпечити йому необхідний час для того, щоб вирішити свої особисті справи та покращити свою ситуацію перед тим, як повернутися до служби. Також можна звернутися до адвоката для консультації та допомоги у цьому питанні.

23.09.2024 15:08:29 Вітаю, зміни в ст. 26 ЗУ "Про військову службу та військовий обов'язок" внесено не було, підстава для звільнення звучить так: якщо їхні близькі родичі (чоловік, дружина, син, донька, батько, мати або рідний (повнорідний) брат чи сестра) загинули або пропали безвісти під час безпосередньої участі у антитерористичній операції, здійснення заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації у Донецькій та Луганській областях, а також під час забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії проти України під час дії воєнного стану. Тому звільнитися він на цій підставі не зможе на жаль.

23.09.2024 15:38:19 Доброго дня! На жаль, даний пункт повернули лише в підставу для відстрочки. Відстрочка надається лише військовозобов'язаним відповідно статті 23 ЗУ "Про мобілізаційну підготовку та мобілізацію". Проте, Ваш брат уже військовослужбовець, тому Вам потрібно зачекати поки депутати внесуть також зміни в підставу для звільнення, а саме частину 12 статті 26 ЗУ "Про військовий обов'язок та військову службу"
