Чи потрібно платити за загубений номерок?

Recently, our team was asked a question: “Я залишила речі в камері схову, коли потрібно було за ними повертатись, я помітила, що номерка немає. Коли я повідомила про це охорону, вони почали вимагати в мене 500 гривень за даний ключ і номер, але я впевнена, що дана річ не коштує 500 гривень, і відмовилась платити. Хто правий в даній ситуації? Як мені діяти?”

26.01.2022 17:49:39 Згідно з Цивільним кодексом, коли людина залишає в камері схову магазину свою річ, зачиняє її на ключ та забирає його, то між покупцем та магазином формально укладається договір зберігання. Підтвердження укладення договору зберігання — номерний жетон або ключ від камери схову з порядковим номером, який надає відвідувачеві магазин, тобто зберігач. З цього моменту магазин несе відповідальність за збереження залишених речей. Також згідно зі ст. 950 Цивільного кодексу, за втрату або пошкодження речі, взятої на зберігання, зберігач, у нашому разі супермаркет, відповідає на загальних підставах. Згідно зі ст. 951 Цивільного кодексу, збитки, завдані людині нестачею або пошкодженням речі, відшкодовує зберігач: у разі втрати (нестачі) речі — у розмірі її вартості, при пошкодженні — в розмірі суми, на яку знизилась її вартість. Тобто платити ви не зобов'язані але якщо відчуваєте провину та хочете врегулювати то вартість брелка 15 грн вкажіть що її і відшкодуєте.

31.01.2022 23:35:23 Камера схову дійсно є власністю магазину, тому за шкоду інвентарю потрібно сплачувати. Проте, для справедливого вирішення даного питання, Вам повинні були надати документи, які б вказували, яка річ скільки коштує. А, також, при сплаті Вами коштів дійсної вартості ключа з номером, за Вашим проханням, відзвітуватись, що ці гроші пішли саме на усунення шкоди. Чи навіть запропонувати Вам особисто купити даний замок з ключем. Якщо Ви сумніваєтеся у вартості даного предмету і правомірності дій працівника магазину, то варто написати рекомендованого листа на адресу керівництва підприємства (дані можна знайти у куточку споживача), з проханням надати Вам письмові пояснення з усіма квитанціями, де зазначено вартість даного номерка та порядку компенсації його вартості.
