Під час виконання наказу було отримане поранення після чого провів лікування в госпіталі. Зараз знову на нульовій позиції, але стан здоров'я погіршується. Писав рапорт на переведення, міри не були прийняті. Чи посадять за грати якщо написати рапорт на відмову виконання наказів????”

21.06.2022 13:30:00 Ви маєте право написати рапорти, проте краще писати реальні рапорти, які будуть задоволені. тобто якщо ви вбачаєте необхідність медичної допомоги та у вас погіршилось здоров'я, то варто звернутися до лікаря та отримати медичні висновки, що підтверджують стан здоров'я та повторно написати рапорт на начальника в/ч з долученням медичних документів. Невиконання наказу - Непокора — військовий злочин, за який передбачено кримінальну відповідальність за 402 ст. ККУ. Слід відрізняти даний злочин від злочину, за який відповідальність передбачається 391 статтею ККУ. Настає за 402 ст. ККУ і полягає у службових обмеженнях для військовослужбовців на строк до двох років або триманні в дисциплінарному батальйоні військовослужбовців на строк до двох років, або позбавленням волі на строк до трьох років. За вчинення злочину групою осіб або в разі настання тяжких наслідків відповідальність підвищується до позбавлення волі на строк від трьох до семи років.
