Recently, our team was asked a question: “Я купив автомобіль по довіреності, та його власник знаходиться в реєстрі боржників, що недає мені можливості зняти авто з реєстру.
Власник зімною на зв’язку, ми подавали заяву в реєстр боржників щоб забрати його з цього списку, так як штраф через який він там - оплачений. Але наші дії не приносять ніякого результату на протязі кількох місяців.
Нам потрібна допомога так як я є власник автомобіля, зацікавлений в тому щоб зняти його з обліку.”

13.07.2022 08:49:50 Після підписання договору купівлі-продажу власник перереєструє автомобіль одразу на нового власника. Це робиться в регіональних сервісних центрах МВС, а сам порядок закріплений постановою Кабміну від 07.09.1998 №1388. Раніше існувала процедура зняття автомобіля з реєстрації, проте вона була скасована у 2018 році. Тепер зняти автомобіль з реєстрації можна тільки в таких випадках: вивезення транспортного засобу за кордон (на постійне місце проживання або при продажу нерезиденту); утилізація; за рішенням суду; в зв'язку зі скасуванням реєстрації автомобіля. У судовому порядку оскаржувати незаконні дії виконавців, подавати скаргу Начальнику виконавчої служби на дії держ виконавців.

13.07.2022 17:31:23 З описаної вами ситуації схоже, що автомобіль перебуває під арештом. Зняти арешт з авто можна двома способами: 1.Звернутись до виконавця, який вів справу по стягненню штрафу з колишнього власника авто. Надати виконавцю квитанцію про сплату штрафу та заяву про закінчення виконавчого провадження та скасування арешту авто; 2.Звернутись до суду з позовною заявою про зняття арешту з автомобіля. Позовна заява подається від вас, як нового власника авто. Перший варіант кращий тим, що займе менше часу, ніж суд. Але зняття арешту з авто цілком залежить від виконавця, тому цей спосіб може не спрацювати. Спробуйте зняти арешт через виконавця, якщо не вдасться, залишиться лише звернення до суду.
