Recently, our team was asked a question: “В мене врізався автомобіль, пошкодили обидва лівих дверей, розбили скло, страхова готова виплатити лише 6000 грн. Куди звертатися, на сто ремонт оцінили в 24 000 грн. Як примусити страхову виплатити більше?”

26.01.2021 19:54:30 Необхідно отримати письмову оцінку транспортного засобу, зроблену в страховій компанії, адже від чогось вони таки відштовхувалися, коли називали вам суму у 6000 грн. Також необхідно встановити чи входить сюди ПДВ. Проте слід пам’ятати, що за полісом цивільної відповідальності можлива франшиза, яку страхова компанія не сплачує і відповідно від суми відшкодування вони просто її мінусують. Я б радив оцінити автомобіль не на сто, а у експерта, який надать висновок про заподіяну шкоду і вартість відновлювального ремонту. З сто взяти рахунок за ремонт. висновок та рахунок треба надати до страхової, якщо виплат не буде то йти до суду. Проте якщо сума виплат страхової не покривають ремонт, за діючим законодавством решту повинен компенсувати винуватець дтп, якого визнано винним рішенням суду
28.01.2021 23:07:01 За законом страхова компанія зобов'язана виплатити відшкодування у межах суми, сплаченої за страховим полісом. Ви, як постраждала сторона, маєте право подати позов про стягнення повної вартості ремонту як до страхової компанії, так і до винуватця ДТП. Перш ніж подавати позов, вам треба отримати копії документів, які були складені поліцією при оформленні ДТП, - це протокол та схема ДТП. З цими документами звертайтесь до адвоката, який напише позов та подасть його до суду. Судова практика по відшкодуванню шкоди внаслідок ДТП на вашу користь, тому варто розраховувати на позитивне рішення.
01.02.2021 19:35:11 Надіслати вимогу на суму ремонту із всіма доказами. Якщо не виплатять добровільно, то тільки через суд можна буде стягнути. Це може затягнутись на певний час і потрібен адвокат. Послуги адвоката теж можна буде відшкодувати через суд.
