Recently, our team was asked a question: “Добрий день, я припаркувався на загальній парковці біля торгового центру. На моєму місці стояла оранжева фішка, я її прибрав, бо підрзрюю що це незаконно ставити такі фвшкі на загальній парковці. Коли вийшов з трц то машини не було, паркувальник повідомив що евакуаатор забрав. Тепер мені треба 1900 штрафу заплатити. Це ж все незаконно, я стояв на парковці, а машину забрав якийсь евакуатор по дзвінку. Що робити? Дякую”

27.04.2021 18:42:12 Доброго дня! Забрати авто просто так не можуть - інспектори зобов’язані зателефонувати власнику та зафіксувати процес евакуації на відео чи фото. Відповідно до ч. 3 ст. 265-2 Кодексу України про адміністративні правопорушення, транспортний засіб не можна забирати на штрафмайданчик, якщо він не перешкоджає дорожньому руху. Для того, щоб дізнатися, де автомобіль, зателефонуйте на 102 - поліція має доступ до бази евакуйованого автотранспорту. Або наберіть гарячу лінію патрульної поліції чи зверніться до Управління (інспекції) з паркування у місті. Оскарження евакуації здійснюється відповідно до ст. 267 Кодексу України про адміністративні правопорушення, де вказано, що це може бути оскаржено у вищестоящий орган (вищестоящій посадовій особі) відносно органу (посадової особи), який застосував ці заходи, або до суду. Процес евакуації транспортного засобу має бути зафіксовано в режимі фотографування чи відеозапису. Дякую!

27.04.2021 20:38:43 Доброго дня, треба зрозуміти чи дійсно ви не порушували правил дорожнього руху своєю парковою. Маю на увазі - чи наявна постанова/протокол про порушення ПДР. Адже евакуація автомобіля можлива якщо порушено правила і лише з боку поліції або інспектую тора з паркування. При цьому складаються акти, протоколи, постанови, документи тощо в автомобіль може бути спрямовано на майданчик. Якщо ви вважаєте що це було свавілля з боку уповноважених осіб ТЦ, может сміло ви подавати заяву про викрадення автомобіля. Також сміливо вимагайте відшкодування матеріальної та моральної шкоди від торгового центру або того, кому фактично належить парковка. Візьміть відео з камер, отримайте інформацію про свідків, телефон з якого телефонували до служби евакуації - все це потрібно для доведення своє правоти
