Доброго дня! Вирішення даного питання залежить від того, на якій підставі нотаріус віддав паспорт. Якщо, наприклад, було використано підроблену довіреність, то особу може бути притягнено до кримінальної відповідальності. Якщо ж документ було передано нотаріусу на зберігання, то в Законі України "Про нотаріат" зазначено, що нотаріуси приймають на зберігання документи за описом. Особі, яка здала документи на зберігання, видається свідоцтво за встановленою формою. Прийняті на зберігання документи повертаються на вимогу особи, яка здала їх на зберігання, або на вимогу уповноваженої нею особи при пред'явленні свідоцтва і примірника опису чи за рішенням суду.

Вітаю, звісно що ні! За незаконне заволодіння особистим паспортом, передбачена кримінальна відповідальність, згідно п. 3, ст. 357 КК України. Разом із цим п. 22 Постанови ВР України № 283/94, "Про затвердження положень про паспорт громадянина України та свідоцтво про народження", паспорт може бути вилучено тільки органами дізнання, попереднього слідства або судом, у встановлених законом порядку. Тобто, Ваш паспорт вилучено незаконно, якщо потрібна юридична допомога - телефонуйте.
