Recently, our team was asked a question: “Воо если я хочу лишить себя родительских прав , и отдать ребенка отцу , что бы он был единственным опекуном, что бы мог уехать за границу, потому что мы лишились дома, я не могу позволить что бы мой ребенок лишился отца.Мне сказали что это можно решить через нотариуса а потом в суд подавать заявку
Все равно папа ей больше сможет дать чем я, мне и так в жизни не повезло , я круглая сирота , все что у меня есть это моя семья
Мне нужен порядок действий , и на сколько жто реально реализовать?”

08.04.2022 18:22:00 Закріпити домовленість можна укласти нотаріально завірений договір щодо здійснення батьківських прав та виконання обов’язків батьком дитини, тобто тим хто проживає з дитиною , в якому батьком дитини можна визначити не тільки участь у вихованні дитини того з батьків, хто проживає окремо , але і встановити місце проживання дитини та порядок її утримання з батьком дитини. Також необхідно вирішити питання чи ви є розлученою, щоб судовим рішенням про розлученням встановити вимогу проживання дитини разом з батьком дитини.СК України встановлено, що місце проживання дитини, яка не досягла 10 років, визначається за згодою батьків. Місце проживання дитини, яка досягла 10 років, визначається за спільною згодою батьків та самої дитини. Якщо батьки проживають окремо, місце проживання дитини, яка досягла 14 років, визначається нею самою.Ст 158 СК закріплено право того з батьків, хто проживає окремо, звертатися із заявою до органу опіки та піклування з метою визначення способу участі у вихованні дити
