Recently, our team was asked a question: “В 2017 году достроил себе комнату к квартире на 1 этаже,пришли с какой-то службы, дали предупреждение, сказали надо узаконить достройку. Как это сделать и какие документы готовить для узаконивания?”

29.01.2021 14:42:51 Узаконить уже существующую пристройку лучше в судебном порядке. Вам нужно подготовить и подать иск в районный суд по месту нахождения пристройки. В иске должно быть указано: кем построено самовольное строение; год начала и окончания строительства; информацию о наличии документов на земельный участок, на котором осуществлено строительство (если таких документов нет - указать, что отсутствуют); кто собственники земельного участка, на котором расположена пристройка; общую площадь пристройки с указанием количества внутренних комнат и помещений. К иску прилагаются: справка о проценте готовности пристройки; технический паспорт на пристройку; техническое заключение проектной организации о соответствии пристройки строительным нормам; документ о праве собственности или праве пользования земельного участка под пристройкой (если нет - нотариальное заявление от собственника земельного участка о согласии на его использование); заключения о соблюдении санитарно-гигиенических и противопожарных норм
30.01.2021 00:09:49 Как должно быть до строительства пристройки - получить разрешение от местной исполнительной власти, соседей, осмд; согласовать проект в архитектурной инспекции; получить технический паспорт (после постройки); получить выписку из реестра о регистрации права собственности. Раз уж постройка есть то пройти то же самое но заплатив штраф в районе 850 грн. Документы для оформления пристройки - паспорт, код, док-ты на квартиру, техпаспорт квартиры. Если в квартире был балкон ранее скажем, а вы его расширили немного то это проще оформить. Раз к вам уже пришли то в предупредительном документе указано куда обратится для оформления пристройки
