13.10.2021 23:21:23 Здравствуйте! Вам нужно обязательно до истечения 6 месяцев принять наследство, т.е. обратиться к нотариусу с соответствующим заявлением. Нотариус оформит свидетелство о праве на наследство на дом, а на землю скорее всего откажет. Но Вы можете обратиться в суд о признании за Вами права и на земельный участок, т.к.согласно ч. 2 и 3 ст. 1225 ГК Украины к наследникам жилого дома, других зданий и сооружений переходит право собственности или право пользования земельным участком, на котором они размещены, а также земельным участком, необходимым для их обслуживания, если другой его размер не определен завещанием. Оформление права собственности на жилой дом сегодня может выполнять нотариус или государственный регистратор через центр оказания административных услуг (ЦНАП), путем занесения данных об объекте и его владельце в Реестр. Порядок оформления дома установлен Постановлением КМУ №1127 от 25.12.2015. Вам в первую очередь, необходимо проконсультироваться с нотариусом по поводу участка земли. Скорей всего Вам нужно будет отстаивать свои права в суде.

16.10.2021 10:46:58 До складу спадщини входять усі права та обов’язки, що належали спадкодавцеві на момент відкриття спадщини і не припинилися внаслідок його смерті.До спадкоємців житлового будинку, інших будівель та споруд переходить право власності або право користування земельною ділянкою, на якій вони розміщені, а також на земельну ділянку, яка необхідна для їх обслуговування, якщо інший її розмір не визначений заповітом.
