Майно, набуте подружжям за час шлюбу, належить дружині та чоловікові на праві спільної сумісної власності незалежно від того, що один з них не мав з поважної причини самостійного заробітку. У відповідності з сімейним законодавством і Цивільним кодексом чоловік і дружина мають право укладати між собою договір про поділ нерухомого майна. Подібна угода дає подружжю можливість в позасудовому порядку вирішити спірні питання майна, а також самостійно визначити частки в нерухомості. Оформлення угоди про добровільний розподіл майна повинно здійснюватися з урахуванням законодавства, яке регулює порядок реєстрації нерухомості. Договір про поділ нерухомого майна, що перебуває у спільній частковій власності, укладається у письмовій формі і підлягає нотаріальному посвідченню. При поділі спільно нажитого майна, частки подружжя є рівними, якщо інше не було визначено домовленістю між ними або шлюбним договором. Дякую!
12.05.2021 18:32:12 Здравствуйте! Развод это первый этап, раз в суде вопрос раздела имущества при разводе не подымался. В таком случае, если вы с уже бывшей женой мирно не разделите имущество то обращайтесь в суд с исковым заявлением о разделе имущества, при этом судебный сбор за подачу такого заявления зависит от оценки самого имущества. После рассмотрения дела снова получите решение суда в котором будет определено какая часть кому достаётся (в зависимости от того что кто просит и конкретных обстоятельств вашей жизни), после вступления решения в законную силу модно перерегистрировать имущество и получать своё право собственности
