Зазвичай, судове оскарження заповіту повинно бути здійснене протягом певного строку після його складання (залежно від законодавства вашої країни). Однак, якщо цей строк минув багато років тому, шанси на успішне оскарження можуть бути обмеженими. Рекомендую звернутися до юриста або правозахисної організації для отримання конкретної поради щодо вашої ситуації.

24.11.2023 10:06:42 Строк звернення до суду з позовом про оскарження заповіту — три роки від дати, коли ви дізнались про існування цього заповіту. Зараз строк позовної давності пропущений. Його можна поновити, однак для цього мають існувати поважні причини, які 20 років тому перешкоджали вам оскаржити заповіт в суді — і мають бути докази цих причин, у вигляді документів. Без наявності поважних причин та підтверджуючих їх доказів суд не поновить строк на оскарження заповіту. Якщо поважних причин немає — звертатись до суду немає сенсу. 20 років — то надто довгий строк, і щоб пояснити суду, чому заповіт не оскаржувався раніше, потрібно мати вагомі причини, чому ви не звертались до суду раніше.

25.11.2023 00:28:14 Копію заповіту неможливо оскаржити незалежно від того коли він був посвідчений,, а ось сам заповіт можна оскаржити на протязі трьох років з моменту коли особа яка його оскаржує про нього дізналася або мала дізнатися
