Recently, our team was asked a question: “Здравствуйте, я припарковался у обочины и выскочил в магазин, когда вернулся машину уже погружали на эвакуатор. Подскажите пожалуйста как теперь забрать ее. Сколько мне нужно платить штрафа? Машина стояла на аварийке, так и уехала. Можно как-то оспорить то что машину на аварийке забрали?”

07.04.2021 21:09:19 Здравствуйте, не приятная история и тянется она достаточно долго. Перед тем как забрать автомобиль нужно выяснить на какую штрафстоянку ее увезли - одно позвонить в полицию или по телефонам стоянок. Перед тем как забрать авто нужно поехать в управление патрульной полиции для получения протокола и копии акта о эвакуации авто. Далее оплатить штраф, квитанцию с собой на штрафстоянку. Кроме протокола, квитанции об уплате штрафа нужны ещё права, техпаспорт и на всякий случай паспорт. Там вы напишете заявление на возврат авто, советую делать копии акта, квитанции. Если считаете что авто забрали не правомерно, можете обратится в суд с исковым заявлением о признании постановления полиции не законным. Аргументируйте свои доводы, полиция должна доказать свою правоту. Стоимость возврата авто - штраф 510, эвакуатор от 800, стояка 150/день. Забирая авто проверьте салон, багажник, бардачок чтобы убедиться в целостности вещей, если уедете со стоянки, а потом обнаружится пропажа - не докажете.

Зупинка транспортного засобу — припинення руху транспортного засобу на час до 5 хвилин або більше, якщо це необхідно для посадки (висадки) пасажирів чи завантаження (розвантаження) вантажу, виконання вимог Правил дорожнього руху (надання переваги в русі, виконання вимог регулювальника, сигналів світлофора тощо). У випадку, якщо Ви лишили авто на більш тривалий час, навіть у випадку увімкненого знаку аварійної зупинки, авто мали право забрати евакуатором. Оскаржити дані дії можна шляхом подання позову до суду. У випадку евакуації, Вам необхідно звернутися до органів поліції для того, щоб дізнатися місцезнаходження Вашого авто, після чого, сплатити штраф, залежно від ваги авто (вимір для транспортування: вага до 2 тонн - 720 грн, до 3 - 840, вище 3 - 1040 грн, перша доба зберігання авто - 144 грн, наступні дні +24 грн) та сама сума штрафу за правопорушення (від 255 до 510 грн).
