Recently, our team was asked a question: “Мені в військовій частині поставили СЗЧ я знаходився в Донецьку в селі мала Мар'янка після контузії я не поїхав до шпиталю а залишився біля передової. На 3 чи 4 день мені комбат сказав що потрібно йти знову на передову я відповів що мені дуже болить голова, він сказав тоді добре їдь додому лікуйся там далі буде видно як воно буде. Зараз я знаходжусь вдома на лікуванні. Скажіть будь ласка як мені поступити в цьому випадку.”

19.06.2022 22:44:53 Самовільне залишення військової частини або місця служби полягає у тому, що військовослужбовець покидає частину або місце служби без законного дозволу на це, рівно як і не повернення до частини після лікування, відпустки або коли військовослужбовець не прибув вчасно до нового місця служби при переведенні. Для солдата строкової служби відповідальність настає, коли СЗЧ триває більше трьох діб. Для військовослужбовців за контрактом кримінальна відповідальність настає, коли кількість днів СЗЧ перевищує десять днів. Якщо ж це вже повторне СЗЧ в контрактника, відповідлальність наступить також після трьох діб. В умовах воєнного стану за самовільне залишення військової частини або місця служби відповідальність передбачена у вигляді позбавлення волі строком від пяти до десяти років. Ще одним видом військового злочину є ухилення, а також відмова від виконання обовязків військової служби, відповідальність за який передбачена статею 409 КК України. 20.06.2022 00:32:40 Доброго вечора. Рекомендую звернутися з письмовим рапортом до командира військової частини у якому роз'яснити підставу і причини СЗЧ, з наданням відповідних доказів (медичних документів).

20.06.2022 10:52:15 Тут помилка в тому, що Вас мали відправити на лікування, і документально це оформити, треба подати заяву з поясненням до ВЧ, щоб виключили запис по СЗЧ. Якщо Вам відмовлять, треба скаржитись в МОУ ел.поштою на zvernmou@post.mil.gov.ua, опишіть своїми словами ситуацію, вимагайте терміново розглянути це питання, вкажіть, можна ще усно на гар.лінію МОУ: 0800500410 (442), 0444544499.
