Recently, our team was asked a question: “Добрый день!
Подскажите пожалуйста, можно ли находиться заграницей более чем 3 месяца ( приехали после 24 февраля) НО при условии того что не оформляли ни беженство ни временную защиту?
И мы находимся в Польше, можно ли с временной защитой перемещаться по Европе или выехать в Украину?
Если да, то нужно ли для этого оформлять какие-то документы ?”

06.04.2022 09:49:06 Закон о помощи гражданам Украины, принятый Польшей, предусматривает: 1. Гражданин Украины, прибывший в Польшу 24 февраля 2022, а также после 24 февраля - получает право находиться на территории Польши до 18 месяцев без оформления документов на право пребывания в стране; 2. Спустя 9 месяцев непрерывного пребывания в Польше гражданин Украины получает право подать документы на получение разрешения на пребывание в Польше в течение 3х лет. Непрерывное пребывание в Польше важный момент: если после прибытия в Польшу гражданин Украины уехал в другую страну Европы, либо поехал в Украину, а потом снова вернулся в Польшу - он теряет защиту, которую даёт закон. Чтобы находиться на территории Польши 18 месяцев необходимо подать заявление на получение справки о предоставлении временной защиты (обратитесь в Управление по делам иностранцев в Варшаве). Без оформления документов о временной защите находиться в Польше свыше 3х месяцев невозможно.

На цій основі ви можете вибрати державу-член, у якій ви хочете користуватися правами на тимчасовий захист, і приєднатися до своєї родини чи друзів у державі-члені, де вони перебувають. Після того, як держава-член надала вам тимчасовий захист, ви все ще маєте право подорожувати в межах Європейського Союзу до 90 днів протягом 180-денного періоду,Ви можете також мати право на дозвіл на проживання як член сім’ї громадянина ЄС чи особи, яка вже легально проживає в ЄС, або в статусі студента, дослідника, стажиста чи працівника. Щоб отримати додаткову інформацію про ваші можливості, вам слід звернутися до компетентних органів країни, де ви зараз перебуваєте. Ви також можете звернутися до Імміграційного порталу ЄС для отримання додаткової практичної інформації та посилань на веб-сайти відповідних національних органів влади.
