Recently, our team was asked a question: “Добрий день, підкажіть, будь ласка, чи підлягають призову на військову службу під час мобілізації військовозобовʼязані особи що не досягли 25-річного віку, які були обмежено-придатними та після проходження ВЛК стали придатними? Чи тільки за їх згодою? Якою нормою закону це регулюється? Маю тимчасове посвідчення військовозобовʼязаного, склад рядовий, категорія 2. Військову службу не проходив, військову кафедру також не відвідував. Посвідчення закінчилось у квітні та потрібно заново проходити ВЛК.”

04.05.2024 18:10:46 Згідно з чинним законодавством України, особи, які не досягли 25-річного віку, можуть бути призвані на військову службу під час мобілізації незалежно від їхнього статусу придатності. Однак, у разі обмеженої придатності та подальшої зміни стану здоров'я після проходження ВЛК і отримання категорії "придатний", особа може бути призвана на службу тільки за своєю згодою. Ваше посвідчення вказує на те, що Ви маєте категорію обмежено-придатний (категория 2). При проходженні повторної ВЛК і отриманні нового роз'яснювального листа Вам буде надано новий статус придатності. Якщо цей статус буде "придатний", то за вашою згодою Ви можете бути призваний на виконання вiйськового обов'язку. Детальна інформацiя про порядок проведення мобiлiзaцiї та правила призову на вiйськовy службy регyлюются Законом Украïни "Про загальний вiйськовий обов'язок та вiйськовy службy". Для отримання конкретного консультaтивного супроводу рекомендацiя звертaтися до специaлiстa юристa або представникa правознавчих оргaнiзaцii.
04.05.2024 20:13:55 Вам потрібно зібрати всі медичні документи і з юридичним супроводом іти до ВЛК. Доказувати статус не придатності до військової служби. Можливо вас визнають не придатним. Потрібно вивчати ваші документи.
