Недавно нашей команде задали вопрос: “Моя мама в пенсионном возрасте оформила себе Пенсию. Пенсию получала в размере 1564 грн , но в один прекрасный момент она начала получать 1250 грн, в банке сказали что это видимо у вас забирает банк в котором вы брали кредит не отдали. Скажите пожалуйста это законно что другой банк забирает деньги через другой банк?”

Доброго дня! Для вирішення цього питання необхідно проаналізувати документи, на підстві яких банк здійснює таке списання коштів.

Вітаю, стосовно саме банку, якщо немає рішення суду, це - незаконно.На практиці подібне відбувається частіше із МФО (мікрозайм), що мають договір з певним банком. Подібне може трапитись у випадку якщо, при отриманні займу на карту, була зазначена карта банку-партнера МФО, у токому випадку без Вашого відома із відповідної карти можуть списуватись кошти на рахунок кредитної установи. Проте законність данної процедури під сумнівом, якщо відповідне не було прописано у договорі. Якщо Вам буде потрібна юридична допомога - телефонуйте.

Добрый день. Деньги может забирать только исполнительная служба в случае открытия исполнительного производства. С пенсии и зарплаты могу забирать не больше 20 процентов. Рекомендую поехать в пенсионный и выяснить куда идут отчисления. Если они не законные то их можно отменить. Если нужна будет помощь в получении информации можем отправить адвокатские запросы.
