Recently, our team was asked a question: “Чоловіка після "бусифікації" в той самий день відправили в частину без проходження ВЛК. Він відмовився проходити ВЛК, але письмову відмову від ВЛК не писав. На словах в ТЦК сказали, що по закону відмова вважається як пройдена ВЛК. Акта мед.огляду відповідно немає. Видали військовий квиток, в якому зазначено "придатний".
Захворювань для відстрочки немає. Але все одно ж повинна була бути ВЛК.
Чи можна оскаржити це і як?”

19.09.2024 10:48:40 Так, у цьому випадку можна оскаржити рішення про призначення на службу без проходження ВЛК. Для цього потрібно звернутися до медичної комісії або військово-лікарської експертизи і подати письмову заяву про проведення обов'язкового медичного огляду. Також можна скласти письмове звернення до військового комісаріату з проханням переглянути рішення щодо призначення на службу без ВЛК. Якщо не отримаєте задоволення на цих етапах, то можна подати скаргу до суду.

19.09.2024 11:53:41 Вітаю! згідно постанови КМУ 560 Ви повинні були пройти обов’язковий медичний огляд. Згідно пункту 22.1. Положення про військово-лікарську експертизу в Збройних Силах України Дані про тих, хто пройшов медичний огляд (прізвище, ім'я та по батькові), діагноз та постанова ВЛК про ступінь придатності до військової служби та про причинний зв'язок записуються в Книгу протоколів засідань ВЛК. Ви можете спробувати оскаржити незаконну мобілізацію, бусифікацію (викрадення), але краще заручитись підтримкою адвоката. Ви в свою чергу пишіть заяви в Генеральну прокуратуру, Державне бюро розслідувань, Національну поліцію, Уповноваженому Верховної Ради з прав людини та повідомляйте про незаконне позбавлення волі (стаття 146 ККУ) та перевищення військовою службовою особою влади чи службових повноважень (стаття 426-1 ККУ)
