Запропонували мені подихати в алкотестер, я погодився, понятих не дали, на відео не знімали. Почали вимагати хабаря. Я відмовив. Вони забрали в мене права та склали протокол. Як мені оскаржити їхні дії в суді? Чи не перевищили вони своїх повноважень? Які помилки допустили?”

20.02.2022 13:37:24 Для оскарження незаконні дії/бездіяльність працівника поліції (незаконний огляд, неналежне спілкування, ігнорування) особа, щодо якої вчинено такі дії, має право в направити скаргу в порядку підлеглості вищому органу або посадовій особі (ЗУ "Про звернення громадян"); повідомити усно за номером "102" або "0-800-50-02-02" (call-центр); звернутися з позовною заявою до суду. Скарга може бути:усною; письмовою. У випадку, якщо дії/бездіяльність працівника поліції містять ознаки злочину, особа має право звернутися з відповідною заявою до Державного бюро розслідувань або його територіальних управлінь. Також варто оскаржити окремо постанову про притягнення Вас до адмін відповідальності та позбавлення вас прав. На оскарження постанови та збір доказів по незаконній постанові про адм. відповідальність рекомендую звернутися за правовою допомогою. Для початку Ви можете подати скаргу на них до керівника поліції або служби безпеки відповідного територіального органу в порядку Закону України «Про звернення громадян». Якщо ж Ви є учасником адміністративного або кримінального провадження, то скарга (клопотання) на незаконні дії/бездіяльність працівників поліції подається відповідно до вимог процесуального законодавства (ст. 267 КУпАП та гл. 26 (ст. 303–313) КПК відповідно).Так звичайно Ви маєте право оскаржити дії поліції в суді, якщо вважаєте їх незаконними. По перше проводити тест на вживання алкоголю співробітники поліції повинні в присутності свідків, по друге і ,що найголовніше, ніхто в нашій країні не повинен вимагати хабар - це злочин.
