Недавно нашей команде задали вопрос: “Есть двое детей. На старшую дочку мать одиночка. Младшая записана на отца и носит его фамилию. Замужем не была,с отцом младшей дочери не живу, алименты он не платит,помогает ей. Так вот,на старшую хочу переоформить мать одиночку,но говорят что нужна справка о доходах отца младшей дочери. Не понимаю,зачем?? Он к старшей не имеет никакого отношения,он не ее отец.”

Доброго дня! Підставою для отримання статусу одинокої матері є відсутність запису про укладення шлюбу або наявність свідоцтва про розірвання шлюбу. Втім, свідоцтва недостатньо. Необхідно підтвердити факт того, що батько справді не бере участі у вихованні дитини. Для цього мати може звернутися до суду з позовом про позбавлення його батьківських прав, з приводу чого буде постановлено рішення суду. Можна також звернутися до поліції у зв'язку з необхідністю розшуку батька у справі за позовом про стягнення аліментів. У цьому разі документом, який підтверджує факт неучасті батька у вихованні дитини, буде відповідна постанова слідчого. Також підставою може стати довідка зі школи, садочка про те, що батько не бере участі у вихованні дитини, або подібний акт, складений та підписаний сусідами. Слід додати, що зазначений перелік документів не є вичерпним, а єдиного встановленого зразка документа, який би засвідчував статус одинокої матері, немає.

Вітаю, ні, при отриманні матеріальної допомоги, довідка про доходи потрібна лише на членів сім'ї, а батько дітей не є членом сім'ї у котрій Ви плануєте отримати матеріальну допомогу. Порядок і право отримання визначено ст . 18.1 - 18.4 СК України. Буде потрібна юридична допомога - телефонуйте.
