Recently, our team was asked a question: “Чоловік є студентом магістерськоі програми іноземного вузу, дуальна форма навчання (довідка від вузу із зазначенням назви програми, років і термінів навчання - початок 4.04). Чи має він право отримати звільнення від мобілізації як студент за ст. 23? Чи достатньо такої довідки або потрібні ще документи для надання у військкомат?”

Так, відповідно до абз.2 ч.1 ст.23 Закону України "Про мобілізаційну підготовку та мобілізацію" призову на військову службу під час мобілізації, на особливий період не підлягають також здобувачі фахової передвищої та вищої освіти, асистенти-стажисти, аспіранти та докторанти, які навчаються за денною або дуальною формами здобуття освіти. Тобто, чоловік не підлягає мобілізації і більше того, може виїхати за кордон (якщо ВУЗ знаходиться за кордоном) навіть під час воєнного стану. Так, довідка є підтвердженням факту навчання, але можуть вимагати і інші документи, такі як наказ про зарахування чи контракт.

26.03.2022 09:43:28 Призову на військову службу під час мобілізації, на особливий період не підлягають також: здобувачі фахової передвищої та вищої освіти, асистенти-стажисти, аспіранти та докторанти, які навчаються за денною або дуальною формами здобуття освіти. Для отримання відстрочки від призову вам необхідно прибути у військкомат та надати довідку від вищого навчального закладу. На підставі довідки військкомат надасть вам відстрочку від призову на час навчання. Також візьміть із собою паспорт та військовий квиток, якщо він у вас є. Інших документів не потрібно.
