Recently, our team was asked a question: “Після лікування надали постанову ВЛК СТ 64в графа згідно розкладу хвороб ( обмежено придатний до проходження військової служби) чи маю я право на перевід в іншу не бойову частину?”

09.09.2022 13:48:01 Відповідно до положення про проходження служби, а саме п82 перевод здійснюється також за станом здоров'я на підставі висновку ВЛК. В самому висновку ВЛК вказується в яких підрозділах Ви можете проходити подальшу службу. Саме медичні працівники визначають де можна продовжувати службу. Як правило, обмежено придатні можуть продовжувати службу в частинах забезпечення, военкоматах, навчальних підрозділах. Перевод здійснюється за поданням рапорту, прикріплення відношення та висновку ВЛК.

09.09.2022 21:01:47 Згідно до п. 20.3. Положення ВЛК https://zakon.rada.gov.ua/laws/show/z1109-08#n1523 Особи, визнані обмежено придатними до військової служби, - непридатні до служби у високомобільних десантних військах, плавскладі, морській піхоті, спецспорудах. Військовослужбовці, визнані обмежено придатними до військової служби, придатні до служби у частинах (підрозділах) забезпечення, військових комісаріатах, установах, організаціях, навчальних закладах. Обмежена придатність дозволяє нести службу тільки в частинах та підрозділах забезпечення, на підприємствах наприклад оборонного направлення, або виконувати ремонтні роботи військової техники, якщо дозволяє спеціальність, або залишитися служити в роті охорони в військкоматі тощо, проте для переводу в іншу частину необхідне направлення з іншої частини.
10.09.2022 16:14:34 Так, треба подавати рапорт командиру про переведення на іншу службу, по п.6.9 наказу МОУ 14.08.2008 №402 ВЛК враховує можливість подальшого проходження військовослужбовцем військової служби на посаді, яка найбільше відповідає стану його здоров'я. По пп.г п.20.3 наказу МОУ 14.08.2008 №402 - одночасно з постановою ВЛК в індивідуальному порядку з урахуванням військової спеціальності, займаної посади, віку, роботи, що фактично виконується, пристосованості до неї того, хто пройшов медичний огляд, у постанові у довільній формі вказується, які види служби та роботи протипоказані цій особі. Особи, визнані обмежено придатними до військової служби, - непридатні до служби у високомобільних десантних військах, плавскладі, морській піхоті, спецспорудах. Військовослужбовці, визнані обмежено придатними до військової служби, придатні до служби у частинах (підрозділах) забезпечення, військових комісаріатах, установах, організаціях, навчальних закладах (ЦЕ Ваш випадок)
