02.04.2021 20:56:57 Статею 69 Сімейного Кодексу України закріплено право дружини і чоловіка на поділ майна, що належить їм на праві спільної сумісної власності, незалежно від розірвання шлюбу. Тобто дружина і чоловік мають право розділити майно за взаємною згодою в тому числі уклавши договір про поділ майна, що є у спільній сумісній власності, який треба засвідчити у нотаріуса. Існує варіант звернення до суду із позовною заявою про поділ майна подружжя, визначення часток за кожним з подружжя. Суд - за місцем знаходження нерухомого майна або реєстрації дружини або чоловіка - як зручніше, але треба сплачувати судовий збір - 1% вартості майна. Варто зазначити, що не все майно вважається спільною сумісною власністю. Існують індивідуально визначені речі, неподільні речі тощо. Також варто зазначити, якщо шлюб не розірвано, але чоловік та дружина проживають окремо у зв’язку з фактичним припиненням шлюбних відносин, то майно, набуте сторонами за цей період може бути за рішенням суду визнане роздільним. Відповідно до чинного законодавства, майно, набуте подружжям за час шлюбу, належить дружині та чоловікові на праві спільної сумісної власності незалежно від того, що один з них не мав з поважної причини (навчання, ведення домашнього господарства, догляд за дітьми, хвороба тощо) самостійного заробітку (доходу). В такому разі, варто укласти шлюбний договір. Він укладається за бажанням сторін як до реєстрації шлюбу, так і в будь-який час після його реєстрації подружжям.
