Recently, our team was asked a question: “Здравствуйте. У меня сложилась следующая ситуация. Я во дворе у себя стрелял с пистолета резиновыми пулями по банкам. Один из выстрелов отрикошетил и попал в собаку соседа. Они этого собаку очень любят, сказали что подадут в суд. Что мне грозит? Как я могу защитится? Спасибо”

Стосовно даної ситуації можна сказати, що з огляду на обставини суд може розглянути це за статтею 89 КУпАП (Жорстоке поводження з тваринами), санкція частини 1 якої передбачає накладення штрафу від двохсот до трьохсот неоподатковуваних мінімумів доходів громадян. Проте, у даній статті рохглядаються саме насильницькі дії, що завдали тварині фізичного болю, страждань і не спричинили тілесних ушкоджень. У Ваших же діях не було умислу та ознак насильства саме відносно тварини. Може бути піднято питання стосовно наявності дозволу на зброю та порушення ст. 193 КУпАП, тут санкцією передбачено накладення штрафу від 7 до 10 нмдг із вилученням зброї та припасів або без такого, проте тут роль грають калібр зброї і швидкість польоту кулі. В любому випадку, необхідно спробувати знайти порозуміння із сусідами та вибачитися за те, що відбулося Можливо, тоді вийде обійтися і без судових тяжб. Дякую!
15.04.2021 22:13:52 Приветствую! Ваша ответственность может быть как административной так и уголовной в случае, если соседи напишут обращение в правоохранительные органы. В зависимости от травм, полученных собакой будет определён и характер ответственности. Административная ответственность предусмотрена статьей 89 Кодекса Украины об админправонарушениях (когда животное не получило повреждений или не было покалечено) - штраф от 3400 до 5100 грн. Уголовная - ст. 299 уголовного кодекса (наступил вред животному) - от 17000 до 51000 грн. Но снова таки нужно доказать вашу вину. Также готовьтесь к проверке законности наличия у вас пистолета, знания порядка обращения с оружием и местом его хранения. Постарайтесь мирно урегулировать этот вопрос с соседями. Вылечите собаку, извинитесь и оплатите моральный вред - будет дешевле и правильнее всего. Ситуацию не в вашу пользу можно хорошо раскачать, так что не теряйте время и старайтесь найти понимание с соседями
