Помилка в прізвищі в штрафі

Recently, our team was asked a question: “Добрий вечір. На мене був накладений адміністративний штраф. Проте, коли складали протокол, у моєму прізвищі допустили помилку. Коли я в реєстрі боржників перевіряю себе по прізвищу, то ніяких шрафів немає. А коли пишу іншу літеру, то є той самий штраф. Чи можу я тепер через це не платити штраф? Дякую”

11.01.2022 19:35:13 Описка у прізвищі не є підставою для анулювання штрафу чи скасування санкцій. Описка — це зроблена судом механічна (мимовільна, випадкова) граматична помилка в рішенні, яка допущена під час його письмово-вербального викладу (помилка у правописі, у розділових знаках тощо). Виправленню підлягають лише ті описки, які мають істотний характер. До таких належать написання прізвищ та імен, адрес, зазначення дат та строків тощо. Вирішуючи питання про виправлення описок чи арифметичних помилок, допущених у судовому рішенні, суд не має права змінювати зміст судового рішення. 12.01.2022 09:57:06 Доброго ранку. У разі несплати штрафу у строк, установлений ч.1 ст. 307 КУпАП (15 днів), постанова про накладення штрафу надсилається для примусового виконання до органу державної виконавчої служби за місцем проживання порушника, роботи або за місцезнаходженням його майна. У порядку примусового виконання постанови про стягнення штрафу за вчинення адміністративного правопорушення з Вас стягується: подвійний розмір штрафу, визначеного у відповідній ст. КУпАП та зазначеного у постанові про стягнення штрафу; витрати на облік зазначених правопорушень. Розмір витрат на облік правопорушень визначається Кабінетом Міністрів України.Постанова про накладення штрафу, за якою стягнення штрафу проведено повністю, з відміткою про виконання повертається органові (посадовій особі), який виніс постанову.Треба розуміти, що в прізвищі помилка, а Ваша адреса та місце роботи вказано вірно, так що врешті решт Вас змусять оплатити штраф, але вже в подвійному розмірі. Сплачуйте та не затягуйте. Дякую.
