Recently, our team was asked a question: “Добрый день. У меня проживает несовершеннолетний родственник (17 лет), внутренне перемещённый (есть справка), родители его далеко. Мы обратились за помощью в Красный Крест - отказали, так как он несовершеннолетний. Сказали что нужны взрослые представители. Скажите, какой документ мне нужно оформить чтобы я выступала как его представитель? Возможно его родителям нужно на меня оформить доверенность?”

27.10.2022 21:45:33 Быть представителями несовершеннолетнего могут: его родители; опекуны/попечители; другие лица (не обязательно близкие родственники). Представлять ребенка вы можете только по доверенности. Доверенность выдаётся от имени обоих родителей и заверяется нотариусом. Если родители в другой стране, выдать и удостоверить доверенность они могут в консульстве Украины. В доверенности важно четко прописать полномочия, которые вы получите.

27.10.2022 22:56:20 Опіка, піклування над дитиною встановлюється органом опіки та піклування, а також судом у випадках, передбачених статтею 60 ЦКУ. Органами опіки та піклування є районні, районні у містах Києві та Севастополі місцеві державні адміністрації, виконавчі органи міських чи районних у містах, сільських, селищних рад (ч 1 ст11). Опіка (піклування) установлюється за місцем проживання особи, що підлягає опіці (піклуванню), або за місцем проживання опікуна (піклувальника). Ст 244 СКУ, опікуном, піклувальником дитини може бути за її згодою повнолітня дієздатна особа. При призначенні дитині опікуна або піклувальника органом опіки та піклування враховуються особисті якості особи, її здатність до виховання дитини, ставлення до неї, а також бажання самої дитини. Якщо на опікунство претендує декілька осіб, то перевага надається: 1. Родичам дитини (незалежно від місця проживання); 2. Cім’ї, в якій дитина проживала на момент виникнення питання про встановлення опіки (піклування);
