Recently, our team was asked a question: “Чоловік працює майстром виробничого навчання ( посада відноситься до педагогічних) на повну ставку в професійно-технічному закладі з 2018 року, згідно змін в ст.23 закону України Про мобілізаційну підготовку і мобілізацію педагогічні працівники закладів професійної освіти мають відстрочку в особливий період (закон 7272 від 11.04.2022). Чи мають право війсьмати порушувати цей закон і відправляти його воювати??”

18.06.2022 09:47:08 Не мають права порушувати, але цей закон набрав чинності 12.06.2022, тому до цієї дати війсьмат мав підстави мобілізувати таких осіб. Лише з 12.06.2022 зявилася по абз.2 і 3 ч.2 ст.23 ЗУ "Про мобілізаційну підготовку та мобілізацію» така категорія осіб, які не підлягають призову на ВС під час мобілізації, крім як по своїй згоді
19.06.2022 10:28:20 Так він має право на відстрочку, проте ст 23 ЗАКОН УКРАЇНИ Про мобілізаційну підготовку та мобілізацію https://zakon.rada.gov.ua/laws/show/3543-12#Text, зазначає, що Особи, зазначені в абзацах четвертому - восьмому частини другої цієї статті, у зазначений період можуть бути призвані на військову службу за їхньою згодою. Тобто Ваш чоловік може бути призваний та мобілізований за його згодою.
20.06.2022 08:56:38 Доброго ранку. Закон діє на всіх і дотримуватись його повинен кожен. Так це є порушенням нещодавно прийнятого законодавства. А чому працівники відділу кадрів у Вашого чоловіка на роботі не забронювали таких працівників?
