Порядок виїзду дитини за кордон без дозволу одного із батьків

3 липня 2018 року Верховна Рада України прийняла закон про зміни "Правил перетинання державного кордону громадянами України", і Закон України No 2475-VIII "Про внесення змін до деяких актів України". Дані поправки вступили в законну чинність 28 серпня 2018 року і упростили процедуру виїзду дітей з України. Згідно з цими поправками стаття 161 Сімейного кодексу України тепер передбачає, що діти можуть безперешкодно перетинати кордон країни без дозволу (довіреності) від другого з батьків якщо беруть участь у:
1. Оздоровчих і лікувальних програмах за кордоном.
2. Освітніх програмах обміну школярами.
3. Зарубіжних і міжнародних олімпіадах.
4. Міжнародних конкурсах будь-якого напрямку.
5. Міжнародних освітніх, наукових, культурних заходах і спортивних змаганнях.
Вирішення питання про виїзд з України терміном до місяця може прийматися самостійно батьком, який постійно проживає разом з дитиною.
Щоб залишити територію України без довіреності один батько зобов'язаний повідомити другого про тимчасовий виїзд з дитиною за кордон, відправивши йому рекомендований лист з повідомленням про вручення.
У такому листі вказуються:
- мета поїздки;
- країна призначення;
- період подорожі.
Використовувати право зарубіжних поїздок з дитиною може і батько, який проживає окремо. Для цього він повинен належним чином виконувати зобов'язання, пов'язані з вихованням дитини і своєчасно виплачувати аліменти на його утримання.
Звернення на отримання згоди направляється одному з батьків з яким проживає дитина. У разі якщо після вручення такого звернення дозвіл не буде надано протягом 10 днів, для його отримання потрібно звертатися в суд. Подібні заяви розглядаються за скороченою процедурою.
При навмисному порушенні термінів перебування дитини за межами України одним з його батьків встановлені адміністративні стягнення
