Recently, our team was asked a question: “Доброго дня, сталася наступна ситуація. У мене інвалідність по зору вже на протязі 12 років, але восени комісія чомусь позбавила мене цього статусу. Куди звертатися щоб повернути? Це треба відразу йти до суду чи до якогось іншого органу? Вдячний”

29.01.2021 13:45:30 Направляйте письмове звернення громадянина до того органу, який прийняв рішення про позбавлення вас інвалідності. У зверненні вимагайте надати копію рішення про позбавлення інвалідності та копій всіх документів, на підставі яких це рішення було прийняте. Це звернення подавайте до органу або особисто (на зверненні вам повинні поставити дату та час вручення) або відсилайте поштою на адресу органа цінним листом з описом вкладення. Відповідь на звернення надається протягом 30 днів з дня його отримання. Якщо відповіді не буде - подавайте повторне звернення. Якщо після повторного звернення відповіді не буде - звертайтесь до адвоката. Адвокат має право витребувати з орагну копії всіх документів через направлення письмового звернення від власного імені (адвокатського запиту). На адвокатські запити зазвичай відповідають. Після отримання документів все одно звертайтесь до адвоката. Адвокат має дослідити документи та пвдготувати позов до суду про оскарження рішення про позбавлення інвалідності.

30.01.2021 01:03:35 Якщо ви не погоджуєтеся із висновком медико-соціальної експертної комісії, ви маєте право оскаржити висновок в позасудовому порядку шляхом написання заяви до обласної або центральної комісії протягом місяця з дня одержання висновку. Існує також клініка українського державного науково-дослідного інституту медико-соціальних проблем інвалідності та науково-дослідний інститут реабілітації інвалідів, але їх висновки носять рекомендаційний характер. Інший шлях як ви правильно зазначили - йти до суду із позовною заявою про оскарження висновку комісії протягом 6 місяців з дня прийняття комісією рішення.

01.02.2021 19:41:22 Спочатку в МСЕК, якщо буде необгрунтована відмова то рішення МСЕК можна оскаржити до суду. Для цього знадобитися адвокат, у випадку виграшу справи, послуги адвоката можна буде відшкодувати через суд
