Recently, our team was asked a question: “Доброї ночі. Придбав за кордоном авто з правим розташуванням керма, чи потрібно у даному випадку переобладнювати авто, і чи існують в Україні норми законодавства які забороняють розташування керма з правої сторони ?”

18.06.2021 10:10:11 Доброго дня. Все залежить від віку авто. Діючий Закон "Про дорожній рух" від 16.07.1993, каже, що рух транспортних засобів з правим кермом не допускається (ст. 29). Постанова ВР України № 3914/XII обмежує дію ст. 29, але ці обмеження стосуються лише авто, які ввезли, купили та зареєстрували в Україні після 1993 року. Тобто, якщо вік Вашого авто та дата ввозу до 1993 року, то Ви можете ним кермувати, в інших випадках-ні. В іншому випадку Вас чекає процедура переобладнання авто. Дякую за запитання.
18.06.2021 15:22:52 Доброго дня! На сьогодні норма про заборону правого керма опосередковано викладена в Законі України «Про дорожній рух». Згідно з ч. 5 ст. 29 даного Закону, до участі у дорожньому русі транспортні засоби з правим розташуванням керма не допускаються. Проте, Закон не регулює відносини, що виникли до набрання ним законної сили. Закон України «Про дорожній рух» вступив в силу 16.07.1993, що означає, що автомобілі, які зареєстровані та поставлені на облік до 16.07.1993 є абсолютно законними. Закон не обмежує тимчасове ввезення таких машин в Україну, але розмитнення авто з правим кермом і перша реєстрація можлива тільки за умови перевстановлення керма. Дякую!
19.06.2021 22:16:20 Можна, якщо авто ввезено в Україну до 1993 року. Справа в тім, що існує закон Україні «про дорожній рух», який набрав чинності в 1993 році і який забороняє рух праворульних автомобілів. Праворульним машинам в обов'язковому порядку необхідно переробити фари за європейськими стандартами. В цьому випадку японська оптика просто замінюється на європейську, яка відповідає державним стандартам. Якщо бажаєте залишити авто собі та проспати реєстрацію то без суду не обійтися. Треба звернутися до мрео та отримати письмову відмову у постановці на облік, яку вже і оскаржити
