Recently, our team was asked a question: “Как приватизировать гараж? У меня в гаражном кооперативе есть гараж уже 5 лет, как получить право собственности на него? Как приватизировать землю под гараж?”

22.01.2021 17:52:15 Для приватизации гаража нужно: получить справку о членстве в гаражном кооперативе (в справке должен быть указан год строительства гаража и что вы полностью выплатили паевое участие в строительстве гаража); заказать разработку технического паспорта у сертифицированного инженера; подготовить пакет документов (справки кооператива и технический паспорт) и подать документы на регистрацию права собственности на гараж в Центр оказания административных услуг и получить Вытяг о регистрации права собственности. Для приватизации земли под гаражом должна быть возможность выделить этот земельный участок в четких границах. Затем разрабатывается проект отвода земельного участка под уже существующее строение, который подается на утверждение в орган местного самоуправления (городской совет, сельский совет и т.п.), которые принимает решение об отводе. Решение городского совета подается на регистрацию права собственности на земельный участок.

22.01.2021 21:20:00 Добрый день, если гараж постройки до 1992 года, то получить соответствующую справку от кооператива, далее заказать разработку технического паспорта у инженера с лицензией на проведение такой работы, после зарегистрировать Право собственности в госреестре и получить выписку. Если гараж постройки до 1992 года то не считается самостроем и считается самовольной постройкой, а значит не нужно вводить его в эксплуатацию, а значит процедура очень простая. Если документов на гараж нет или он построен без соблюдения норм строительства, то сложнее - штраф за самовольное строительство, проблемы с легальным подведением коммуникаций, открытием счетов, а значит нужно получить разрешительную документацию. Чтобы оформить документы на гараж - паспорт, код, копии документов на землю от кооператива, справку членства в кооперативе с годом постройки гаража и информацией о выплате паевой части. Кооператив должен быть официально зарегистрирован и иметь в собственности зем. участок, адрес, эксплуатац.документы
