23.06.2022 13:23:08 У разі спливу 1095 денного строку з дня виникнення податкового боргу, такий борг визнається безнадійним та підлягає списанню, у тому числі пеня та штрафні санкції, а відтак з того часу в контролюючого органу відсутнє право вживати будь-які заходи щодо стягнення такої суми боргу.

23.06.2022 14:18:02 Так, це процедура визнання податкового боргу безнадійним, стосовно якого минув строк давності (п.п.101.2.3 п.101.2 ст.101 ПКУ) робиться через податкову інспекцію або орган на місцем реєстрації платника, але, це якщо такий борг не стягнули по рішенню суду. Якщо його стягнули по рішенню суду, але на час звернення до суду минув встановлений п.102.4 ст.102 ПКУ строк давності в 1095 днів з дня виникнення податкового боргу, то це було б підставою для відмови в суді стягнути його, але якщо Ви не приймали участі у розгляді в суді, то треба подати апеляцію і просити скасувати рішення суду, прийняти нове про відмову в позові через закінчення строку давності. Якщо борг стягнули по рішенню суду, але строк 1095 днів не минув на час звернення до суду – то це було законне стягнення і всі подальші негаразди

23.06.2022 23:12:14 Самостійно податкові борги не списуються. Зменшувати суму можна за рахунок штрафних санкцій.Строки позовної давності, передбачені статтями 256, 257, 267 ЦК України, відрізняються від строку давності стягнення податкового боргу, визначеного статтею 102 ПК України, який є строком існування відповідного податкового зобов’язання, по закінченню якого воно припиняється в силу закону та є неможливим вжиття будь-яких заходів з його погашення. Відповідно до положень ПК України встановлено граничний строк для визначення контролюючим органом розміру податкового боргу, який «починається за наслідком прийняття рішення податкового органу або самостійного декларування боржником податкових зобов’язань, та не може перевищувати 1095 календарних днів з моменту самостійного декларування податкових зобов’язань або прийняття відповідного рішення про нарахування податкового боргу контролюючим органом, по закінченню яких він уже не може вживати заходів до стягнення податкової заборгованості у будь-якому по
