05.11.2024 00:44:30 Чинним законодавством не передбачено чіткого строку, протягом якого командир зобов’язаний розглянути саме рапорт на звільнення та звільнити військовослужбовця.Але Інструкція з діловодства в Збройних Силах України містить положення, яке встановлює загальний 30 денний строк для виконання документів, в яких не зазначено строк виконання. Перебіг 30 денного строку розпочинається з моменту реєстрації документа у військовій частині, до якої він надійшов.За загальним правилом рапорт на звільнення має бути розглянутий командиром протягом 30 днів з моменту його реєстрації в стройовій частині.Розглянутим вважається рапорт той, по якому прийнято рішення та це рішення чи відповідь доведена до військовослужбовця належним чином. Якщо протягом 30 денного строку відповідь з рішенням по поданому рапорту відсутня, то варто написати рапорт з проханням надати відповідь безпосередньому командиру або направити рапорт командуванню вище, із зазначенням строку подання первинного рапорту.
