10.03.2021 12:33:54 Є дві підстави, за яких квартира може стати спільною сумісною власністю подружжя: 1 - квартира придбана під час шлюбу; 2 - квартира придбана за спільні кошти подружжя. Якщо квартира придбана вами за власні кошти, то вона є вашою особистою приватною власністю, незважаючи на те, що була придбана за час шлюбу. Ніяких прав у вашої дружини на цю квартиру немає, та поділу ця квартира не підлягає. Щоб продати квартиру, вам треба довести, що квартира придбана за ваші особисті кошти. Для цього треба надати документи, які підтвердять, що кошти, за які придбана квартира, належить вам. Це можуть бути виписки з банку про перерахування вам коштів у вигляді зарплати, чи інших доходів, договір з банком, якщо гроші ви брали у кредит, чи інші документи (залежно від ситуації), які підтвердять, що ви придбали квартиру за власні кошти, а дружина фінансово у придбанні квартири участі не приймала. Якщо цей варіант не вдасться, треба подавати позов до суду, визнавати, що квартиру ви придбали за власні кошти.

12.03.2021 18:20:12 Так, за загальними правилами сімейного та цивільного кодексів, майно, набуте за час шлюбу вважається спільною сумісною власністю, якщо звісно ви не укладали шлюбний договір. Якщо ви купували квартиру за особисті кошти і це не прописано у договорі купівлі продажу і ваша дружина вважає цю квартиру і своєю також, тоді вам залишається звернутися до суду із позовною заявою про поділ майна подружжя де ви вкажіть що квартира придбана за ваш рахунок. Потрібно буде довести ці обставини краще документально - можли вам подарували кошти або інше майно, яке ви продали та на ці гроші купили квартиру або щось подібне. Можливо дружина і дня не працювала - це буде суттєвим для визнання квартири за вами. Якщо дружина не наполягає то може надати всього навсього згоду на продаж і все
