В 35 статті конституції України написано, що у разі якщо виконання військового обов'язку суперечить релігійним переконанням громадянина, виконання цього обов'язку має бути замінене альтернативною (невійськовою) службою. Роз'ясніть прошу наступне: 1) "військовий обов'язок" також відноситься до військового стану? 2) Якщо релігійні переконання та світогляд суперечить вбивати, військовому обов'язку, чи можна на підставі даної статті вимагати переведення в тилові частини війська?”

Але немає роз'яснень щодо застосування цієї норми на практиці, зокрема в умовах воєнного стану. Тому з однієї сторони, Ваші думки слушні, а з іншої - все складно, адже з доведенням факту суперечності виконання військового обов'язку релігійним переконанням можуть бути труднощі.
