Recently, our team was asked a question: “Чоловік, у 1999 році через відсутність бланків отримав замість військового квитка довідку. В ній вказано, що він визнаний ВЛК непридатним до військової служби з виключенням з військового обліку. В обліково-послужній картці вказано теж саме та є посилання на ст.30а, наказу МОУ №2 від 1994 року. Також є штамп у паспорті "не військовозобов'язаний". Чи достатньо цих документів для перетину кордону в умовах воєнного стану?”

15.06.2022 15:27:02 За останніми актуальними розясненням прикордонної служби від 03.05.22 на сайті https://dpsu.gov.ua/ua/Peretinannya-derzhavnogo-kordonu-v-umovah-pravovogo-rezhimu-vonnogo-stanu/ можуть виїхати за кордон: 1. Визнані непридатними до ВС за станом здоров’я з виключ.з військ.обліку (на підтвердження - тимчасове посвідчення військовозоб. або військ.квиток з відміткою) 2. Визнані відповідно до висновку ВЛК тимчасово непридатними до військ.служби за станом здоров’я на термін до 6 місяців, на підтвердження: висновок ВЛК; військово-обліковий документ з відповідною відміткою. Тобто, прикордонники можуть не сприйняти стару довідку з записом про виключення з військ.обліку по непридатності, хоча на мій погляд такої довідки має бути достатньо. Раджу Вам перед виїздом запитати за тел.гар.лінії прикордонної служби (область, в якій плануєте перехід або виїзд, буквально чи достатньо старої довідки про непридатність чоловіка і виключення з обліку) https://dpsu.gov.ua/ua/contacts/state_border_guards/

15.06.2022 16:54:13 Ні з зазначеними документами він кордон не перетне. Відомості зазначені у його документах за 1999 р вже станом на 2022 рік не актуальні. Нормативний акт, що регламентує це питання, — Положення про військово-лікарську експертизу в Збройних Силах України, затверджене наказом Міноброни від 14.08.2008 № 402. Повторний медичний огляд військовозобов’язаних, які перебувають у запасі 1 і 2 розрядів, раніше визнаних придатними до військової служби або непридатними до військової служби в мирний час за станом здоров’я, які можуть бути вилікувані, а також військовозобов’язаних плавскладу ВМС Збройних Сил України проводиться один раз у 5 років ВЛК військових комісаріатів, а льотного складу — ЛЛК військових комісаріатів (абз. 3 п. 3.2 Положення № 402).
