Recently, our team was asked a question: “Доброго дня. Я хочу привозити матеріали із Європи та виробляти товар на території України щоб потім експортувати в США. Яку систему оподаткування слід обрати? Що краще відкрити - ТОВ чи ФОП?”

01.10.2020 20:49:03 Як ФОП (фізичні особи- підприємці) так і юридичні особи мають право займатися зовнішньоекономічною діяльністю. Для ведення зовнішньоекономічної діяльності не має значення, на якій системі оподаткування Ви пербуватимете : загальній чи спрощеній. Платник єдиного податку може здійснювати зовнішньоекономічну діяльність як на території України, так і за її межами. Але за умови, що він не здійснює види діяльності, які не дають права застосовувати спрощену систему оподаткування.Перед початком роботи потрібно визначитися з планованими рівнями податкових платежів.Щод обрати оптимальний варіант системи оподаткування (а разом з тим вибрати форму власності та схему роботи) потрібно мати уяву про: 1. Запланований обсяг операцій за рік, 2.Кому будуть надаватися послуги або продаватися товари - юр./фіз. особи,нерезиденти.3.Чи потрібен статус платника ПДВ. 4.Яка націнка (прибутковість) планується. 5.Яка кількість працівників планується.6. Чи планується виводити прибуток.

Оскільки Ви сплачуватимете ПДВ на митниці при ввезенні матеріалів, то для повернення цього ПДВ при експорті (так звана нульова ставка ПДВ) Вам потрібно бути платником ПДВ, це - єдине, що можна сказати остаточно. Для більш детального аналізу майбутньої системи оподаткування потрібно робити розрахунки, виходячи з планових доходів/витрат. Це може бути як єдиний податок 3% з ПДВ, так і загальна система з ПДВ. Якщо у Вас, як це буває, при виході на ринок, якийсь період часу не буде прибутку, то сплачувати 3% єдиного податку з усіх доходів не варто, вигідніше на такому етапі бути на загальній системі оподаткування. Що стосується організаційно-правової форми (ТОВ чи ФОП), то тут теж нема єдиної загальної рекомендації, але якщо Ви вкладаєтесь у бізнес як одна особа, без партнерів, та збираєтесь жити за рахунок цього бізнесу, але й готові відповідати усією своєю власністю по боргах цього бізнесу, то обирайте ФОП; якщо партнерів, які вкладаються у бізнес більше одного - ТОВ.
