Шлюбний договір - це угода, в якій визначаються майнові права та обов'язки кожної зі сторін у шлюбі і у випадку його розірвання.
Згідно ч. 1 ст. 92 Сімейного кодексу, шлюбний договір може укладатися між подружжям. Тобто чоловік і дружина можуть в будь-який момент спільного життя (а не тільки до укладення шлюбу) скласти шлюбний договір. У законну силу документ вступить після того, як його завірить нотаріус.
Також укласти такий контракт можуть особи, які подали заяву про реєстрацію свого союзу. Діяти він почне після реєстрації шлюбу.
У шлюбному договорі слід докладно прописувати всі умови, які подружжю слід дотримуватися протягом спільного життя. Також контрактом передбачаються такі моменти:
- про режим володіння майном;
- про розпорядження сімейними доходами;
- про долю нажитого в разі розлучення.
Для укладення шлюбного договору слід дотримуватися певного алгоритму.
В першу чергу подружжю потрібно прийти до єдиної думки по всіх пунктах і усно обговорити їх, а вже потім перейти до письмового оформлення.
Звернути увагу, що предметом шлюбного договору можуть виступати тільки майнові питання.
Для складання і завірення договору звертатися до нотаріуса слід подружжю одночасно. Для підписання всіх документів при собі потрібно мати:
- паспорта кожного з подружжя;
- свідоцтво про шлюб (якщо є);
Договір складається за затвердженим зразком. Залежно від ситуації і побажань пари, нотаріус може вносити в нього свої зміни.
Останній етап - отримання свого примірника договору. Цей документ складається відразу в 3-х примірниках, тому ніякі копії робити не потрібно: один з них залишається у нотаріуса, інші два - видаються на руки кожному з подружжя.
