Recently, our team was asked a question: “Мій брат солдат срочник, прослужив в армії 1,5 роки і не був у відпустці не відпускали, зарез розпочалася війна і він вже служить 1.8 роки і його так і не відпускають у відпустку, чи має право він піти на 10 днів у відпуску, під час воєного стану, з тим що він не був ще ні разу вдома?”

21.08.2022 20:55:58 Питання щодо порядку надання відпусток військовослужбовцям регулюється ст 10-1 ЗУ “Про соціальний та правовий захист військовослужбовців та членів їх сімей”. В особливий період під час дії воєнного стану військовослужбовцям можуть надаватися відпустки за сімейними обставинами та з інших поважних причин із збереженням грошового забезпечення тривалістю не більш як 10 календарних днів без урахування часу, необхідного для проїзду в межах України до місця проведення відпустки та назад, але не більше двох діб в один кінець. До сімейних обставин відносяться такі випадки: - укладення шлюбу - тяжкого стану здоров'я або смерті рідних по крові або по шлюбу - пожежі або іншого стихійного лиха, яке спіткало сім'ю військовослужбовця ; - в інших виняткових випадках, коли присутність військовослужбовця в сім'ї необхідна, за рішенням команидра. - або з інших поважних причини - перелік не є вичерпним.

21.08.2022 21:47:15 Так він має право на відпустку, для цього йому необхідно звернутись з рапортом до командира в/ч. Рішення про надання відпустки приймає командир військової частини. Відповідно до пункту 18 статті 10 Закону України «Про соціальний і правовий захист військовослужбовців та членів їх сімей» в особливий період під час дії воєнного стану військовослужбовцям можуть надаватися відпустки за сімейними обставинами та з інших поважних причин зі збереженням грошового забезпечення тривалістю не більше як 10 календарних днів без урахування часу, необхідного для проїзду в межах України до місця проведення відпустки та назад, але не більше ніж дві доби в один кінець Сімейні обставини та інші поважні причини, коли військовослужбовцю може надаватися ця відпустка, Законом України, не встановлені.
