07.02.2021 00:07:53 На сьогодні, не зважуючи на зміни в нормативно-правових документах відповідальність за керування транспортом у стані алкогольного сп’яніння все ще встановлена ст.130 кодексу України про адміністративні правопорушення. Відповідальність - штраф 10200 грн. та позбавлення права керування транспортом на 1 рік з дня винесення судом рішення за протоколом поліції про адміністративне правопорушення щодо вас. Раджу з’явитися в суд на виклик та якщо на вашу думку співробітники поліції діяли в супереч закону, вкажіть про це. Перегляньте матеріали справи у суді і надайте свої пояснення щодо матеріалів справи, доказам поліції та фактичними подіями. Допустима норма 0,2 проміле в крові алкоголю. Взагалі, здається немає нічого простішого, як не робити щось - для того, щоб не бути притягнутим до відповідальності за ст.130 купап все що потрібно це не сідати за кермо у стані сп’яніння. Це все, це так просто, просто нічого не робити...

07.02.2021 08:38:45 Доброго дня. Нажаль, Ваша відмова від проходження медичного обстеження на стан сп'яніння прирівнюється до керування в стані сп'яніння. Це із поганих новин. Однак, станом на сьогодні ст.130 КУпАП передбачено наступне - "Керування суднами особами, які перебувають у стані алкогольного, наркотичного чи іншого сп’яніння або під впливом лікарських препаратів, що знижують їх увагу та швидкість реакції". Тобто, статтею передбачено керування саме судном а не автомобілем. Зважаючи на Вашу ситуацію, на мою думку є декілька алгоритмів дій: 1. Намагатися затягнути розгляд справи, оскільки на притягнення вас до адмін. відповідальності у судді є 3 місяці. 2. Наполягати на відсутності в ваших діях складу адміністративного правопорушення за ст.130 КУпАП. 3. Визнати провину, сплатити штраф 10 200 грн., пробути рік без права керування.
